hereinafter referred to as the "Seller", publishes a Public offer to sell the Goods remotely.

1.TERMINES AND DEFINITIONS


1.1. The Public Offer (hereinafter referred to as the “Offer”) is the Seller’s public offer, addressed to an indefinite number of persons, to conclude a contract for the sale of goods with the Seller remotely (hereinafter referred to as the “Contract”) under the conditions contained in this Offer, including all Appendices.

1.2. Ordering Goods on the website of the online store - the positions specified by the Buyer from the range of Products offered for sale when placing an order for the purchase of Goods on the website of the Online Store.

2. BASIC PROVISIONS


2.1. The Buyer's order of the Goods placed on the  Online Store website means that the Buyer enters into the Public Offer Agreement and agrees to all the terms and conditions of this Offer.
2.2. The administration of the website of the online store has the right to make changes to the Offer without notifying the Buyer.

2.3. This Public Offer, as well as information about the product, presented on the Website, is a public offer in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.2.4. Services are considered to be fully provided by the Seller from the moment the Goods are transferred to the Buyer.

2.5. If the Seller needs additional information, he is entitled to request it from the Buyer. If the Buyer does not provide the necessary information, the Seller shall not be liable for the Goods selected by the Buyer.

2.6. By accepting the terms of the Public Offer, the Buyer agrees to the collection and processing of personal data by the Seller.
2.7. Acceptance by the Buyer of the terms of this Offer is carried out by the Buyer entering the relevant data when placing an order on the website of the online store or when placing an order through the manager of the online store. After placing the Order through the manager of the online store, the data about the Buyer is registered in the database of the Seller. Having approved the Order of the selected Goods, the Buyer provides the manager of the online store with the necessary information in accordance with the procedure specified in clause 4.5. this Offer.

3. Product information


3.1. The goods are presented on the Website through photo samples, which are the property of the Seller.
3.2. Each photo sample is accompanied by text information: price and description of the goods.
3.3. At the request of the Buyer, the Manager of the online store is obliged to provide (by phone) other necessary information. All information materials presented on the Site are for reference only and can not fully convey accurate information about certain properties and characteristics of the Goods, such as: price, color, shape, size and packaging. In the event of the Purchaser issues concerning the properties and characteristics of the Goods, before ordering him to seek the advice of the Manager of e-shop myshop@airastana.com

3.4. Stated on the website price may be altered by the Seller unilaterally.
3.5. The price for any position of the Goods reflects only the cost of the Goods, excluding taxes, customs duties, installation, assembly and transportation services.
3.6. The seller indicates the cost of delivery of the goods on the website of the online store.

4. Order of purchase of goods


4.1. The buyer has the right to place an order for any Product presented on the Website.
4.2. After placing the order, the Manager of the online store contacts the Buyer by phone to receive confirmation of the order and agree on the time and terms of delivery.
4.3. In the absence of Goods in stock online store Manager is obliged to inform the Buyer.
4.4. The buyer has the right to refuse the ordered Goods at any time prior to its dispatch to the Buyer, having informed the Seller about it in advance by e-mail myshop@airastana.com
4.5. When ordering online store Buyer agrees to provide the following information:
4.5.1. surname, name of the Buyer or the person specified by him (the recipient);
4.5.2. the address to which the Goods should be delivered (if delivery to the address of the Buyer);
4.5.3. email address;
4.5.4. contact phone number.
4.6. The seller is not responsible for the content and accuracy of the information provided by the Buyer when ordering.
4.7. The contract of sale by remote means between the Seller and the Buyer shall be deemed concluded from the date of issue by the Seller to the Buyer of a cash or sales receipt or other document confirming payment for the Goods.

5. Delivery of goods


5.1. The Buyer can pick up his Order on his own (pickup), within 5 working days after payment of the order. The addresses of the pickup point are specified with the manager of the online store. Pickup addresses are listed in Appendix 1.
5.2. Sending and delivery of the ordered Goods shall be made in the time agreed with the Buyer after the payment of the Goods and the cost of delivery.
5.3. Courier delivery - is carried out at the address specified at checkout. If you need to deliver the goods to a different address, you must provide the address to the manager who will contact the Buyer after placing the order on the Site.
 5.4. Delivery is carried out daily from 10:00 to 17:00 hours, except weekends (Saturday, Sunday). Goods ordered by the Buyer on Saturday and Sunday are delivered on Monday. Delivery time depends on stock availability.
5.5. In case of mechanical damage of the Goods to obtain a guarantee exchange, the Buyer is obliged to open the package in the presence of the courier and draw up an act of damage to the Goods.
5.6. The ownership of the Goods, as well as the risk of damage to it, shall pass to the Buyer from the moment the Goods are transferred to the Buyer.
5.7. The delivered Goods shall be transferred to the Buyer, and in the absence of the Buyer - to any person presenting a receipt or other document confirming the conclusion of the Contract or the delivery of the Goods.

6. Payment for goods is carried out:


6.1. By transferring cash by the Buyer online through the electronic payment system ePay of Kazkommertsbank JSC by cards.

6.2. The obligations of the Buyer to pay for the Goods shall be deemed fulfilled from the moment the funds are received on the settlement account of the Seller.

7. Return of goods


7.1. The buyer has the right to refuse the ordered goods at any time prior to its receipt and within 14 days after receipt of the goods, not counting the day of purchase. The return of the Goods of good quality is possible if their presentation, consumer properties, as well as a document confirming the fact and conditions for the purchase of the specified Goods are preserved.

7.2. If the Buyer refuses the Goods in accordance with clause 7.1, the Seller returns the value of the returned Goods to him, excluding the Seller’s expenses for the delivery of the returned Goods from the Buyer, no later than 10 days from the date the Seller receives the Buyer's written statement.

7.3. If, at the time of the Buyer's request, a similar product is not available from the Seller, the Buyer has the right to refuse to execute the contract of sale and to demand the return of the amount paid for the specified Goods. The seller is obliged to return the sum of money paid for the returned goods within 7 working days from the date of the return of the goods.

8. Obligations of the Seller:

 

8.1. Maintain confidentiality of data about the buyer. Buyerы data may be provided only in cases stipulated by the legislation of the Republic of Kazakhstan.
8.2. Provide the Buyer with the opportunity to obtain information about the status of his order.

8.3. The Seller is not responsible for the actions of related services and services used to provide the Services to the Buyer, but not belonging to the online store: banks, transport companies, Internet service providers, payment systems, etc.

 

9. Buyer Responsibilities


9.1. The Buyer undertakes to familiarize himself with the text of this Agreement, to check for changes to the Agreement and its annexes.
9.2. If there is a lack of necessary information from the Buyer, the Seller reserves the right not to provide services to the Buyer.

 

10. Settlement of disputes


10.1. Claims of the Buyer are accepted as an e-mail no later than 3 (three) business days from the date of receipt of the Goods by the Buyer. Claims are considered within a period not exceeding 10 (ten) business days from the date the Claim is received.
10.2. If circumstances arise that prevent the seller from fully or partially fulfilling his obligations under this Agreement, in particular: natural disasters (fire, flood, earthquake, etc.), war and military operations of any kind, blockade, embargo, export ban and imports, epidemics, changes in legislation in the countries of the manufacturer, the Seller and countries of possible transit of equipment and other extraordinary circumstances that the Seller could not have foreseen or prevented By reasonable measures in the course of the execution of this Agreement, the period established for the fulfillment of obligations under this Agreement will be prolonged for the time during which such circumstances were valid or may be terminated by the Seller unilaterally. In this case, the Seller returns the amount of the payment within a reasonable time.
10.3. The seller has the right to change or delete without notice Buyers of any information posted on the website of the online store.

Carefully read the text of the Public Offer, and if you do not agree with any clause of the Offer, you have the right to refuse to purchase the Goods provided by the Seller and not to perform the actions specified in paragraph 2.1. this Offer.
